TERMS OF USE OF THE WEBSITE
The website of the companies “GEORGIOS M. TSAKOUMIS AND Co L.P.” with the distinctive title “CONSORTIS” and “CONSORTIS GEOSPATIAL L.P.” with the distinctive title “CONSORTIS GEOSPATIAL” (hereinafter jointly the “Companies”) constitutes the electronic space of communication and information regarding the services provided by the companies (hereinafter the “Website”).
The Companies act as Joint Controllers pursuant to Article 26 GDPR to the extent that they jointly determine the purposes and means of the processing of personal data, in particular within the framework of the operation of common organizational units (indicatively: HR, IT, Legal, Accounting, Marketing, Contracts Directorate, Tenders and Secretariat), the use of common information systems and technical infrastructures, the provision of unified administrative and business services. The Joint Controllers have determined through an internal Joint Controllership Agreement: the allocation of their responsibilities as regards compliance with the GDPR, the procedures for safeguarding the rights of data subjects, the appropriate technical and organizational security measures, the manner of their cooperation with supervisory authorities. The essence of the above allocation is made available to the data subjects upon request.
The use of the Website is subject to the terms set out herein (hereinafter the “Terms of Use”) as well as to the remaining informative links that constitute integral parts of the Website, namely the Privacy Policy and the Cookies Policy. The user is invited to read the Terms of Use carefully and to proceed to use of the Website only if he/she fully accepts them. In case he/she does not agree with the Terms of Use, he/she must not make use of the services and content of the Website.
The user is requested to check the content of the Terms of Use of the Website for possible changes. The continued use of the Website even after any changes signifies the user’s unconditional acceptance thereof.
- Intellectual Property Rights
Except for the expressly mentioned exceptions (copyrights of third parties and partners, as well as the intellectual property of the source code, which belongs to the company that has constructed the Website), all the content of the Website which – indicatively – includes informational material of any form, texts, photographs, designs, logos, etc., constitutes intellectual property of the Companies and is protected by the applicable national, European and international law on trademarks, industrial and intellectual property and unfair competition. None of the above may constitute, in whole or in part, an object of sale, copying, modification, reproduction, republication, or be stored, transmitted or distributed in any way.
An exception is the case of individual storage of one and only copy of part of the content on an electronic computer for strictly personal and not public or commercial use and without removal of the indication of their origin from the Website, without in any way affecting the relevant intellectual and industrial property rights.
The Companies, in case of infringement of the above rights, reserve the right to claim any damage caused to them, direct or indirect, positive or consequential, according to the provisions of the applicable legislation.
- User Responsibility
The user must comply with the rules and provisions of Greek, European and International Law and the relevant legislation governing telecommunications and refrain from any illegal and abusive behaviour during the visit/use of the Website. He/she is further obliged to use the Website in accordance with the law, good morals and the Terms of Use and not to proceed to acts or omissions that may cause damage or malfunction to it, affect or endanger the provision of services through the Website. Finally, he/she undertakes the responsibility to restore any damage caused to the Companies and/or to the Website from bad, illegal or unfair use of the Website and the services offered through it.
- Social media
The Website provides the option of interaction with social media, namely the option “Like” or “Follow” of Facebook, LinkedIn, YouTube and X. This option may allow access to each user’s accounts on social networks. The Companies do not have access to these services of social networks nor to the users’ profiles on them. However, each user is recommended to read all the information regarding the services of the respective social media before proceeding to any option available on the Website, so as to be better informed regarding their privacy policies. The Companies are not responsible for the actions or omissions of any social media service provider or for the use by the users of the options included in their platform.
- Limitation of Liability – Disclaimer
The Companies make every possible effort for the proper operation of the Website, without however guaranteeing that, despite the taking of all required security measures, its functions and the functions of the servers that host it will be uninterrupted, without any kind of error, free from viruses or other harmful elements.
The Companies, under any circumstances, including the case of negligence, are not liable for any form of damage, direct or indirect, related in any way to the use of the services and content of the Website suffered by the user, which he/she undertakes on his/her own initiative and with the knowledge and acceptance of the Terms of Use.
Each user must take all appropriate security measures (indicatively antivirus protection programs) before any “upload” to the Website. The cost of any possible corrections or repairs is borne by the user and in no case by the Companies.
The Website operates as a means of communication and information regarding the services provided by the Companies. The Companies bear no responsibility for any damage of a third party due to an act or omission that was based in whole or in part on the content of the Website. The information included in the Website constitutes an informational offer to each user, does not constitute professional advice and in no case conceals an encouragement to perform a specific act or omission.
- Links to other Websites
The interconnection of the Website with other websites through links is carried out only for the convenience and fuller information of the users and the use of these links is made under the sole responsibility of the users themselves. The said websites are subject to their own terms of use, for which the Companies bear no responsibility.
The Companies seek the best possible quality and reliability of the websites to which they refer. However, they cannot control at all times the availability, the content, the completeness of the services and the personal data protection policy of these websites, nor intervene with corrections in their content.
For any problem presented during the visit/use of the websites to which the Website refers, the user must inform the Companies and address directly these websites, which bear the relevant responsibility for the provision of their services. The Companies are not liable for any direct or indirect, positive or consequential damage of the users resulting from the exploitation of the possibility of interconnection with the said websites.
- Applicable Law – Other Terms
The Terms of Use, as well as any change or modification thereof, are governed and supplemented by Greek law, the law of the European Union and the relevant international treaties. In case of failure of amicable settlement of disagreement or dispute, exclusively competent for its resolution shall be the Courts of Thessaloniki.
Any provision of the Terms of Use that becomes contrary to the law automatically ceases to apply and is removed from the present, without in any case affecting the validity of the remaining terms.
The present constitutes an agreement between the Companies and the users of the Website and binds only them. No modification of the Terms of Use shall be taken into account and shall not constitute part of this agreement unless it has been formulated in writing and incorporated into it.
Because the Terms of Use may be modified, you must regularly be informed about the content hereof and check for any changes.
